End-User License Agreement (EULA) – XPr Ensue

This End-User License Agreement (”EULA”) is a legal agreement between you and [Xperience Health Sverige AB] for the use of the XPr Ensue mobile application (”App”) provided by [Codavjas AB] on behalf of Xperience Health Sverige AB (”Xperience Health”). By downloading, installing, or using the XPr Ensue App, you agree to be bound by the terms and conditions of this EULA. Please read this agreement carefully before using the App.

License Grant Subject to your compliance with the terms of this EULA, [Xperience Health Sverige AB] grants you a personal, non-exclusive, non-transferable, and limited license to download, install, and use the XPr Ensue App on your mobile device for personal, non-commercial use only.

Restrictions on Use You may not, and you agree not to, permit others to:

1. Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the App; b. Remove, alter, or obscure any proprietary notices or labels on the App; c. Use the App for any illegal or unauthorized purpose or in any way that could damage, disable, overburden, or impair the App’s functionality; d. Attempt to gain unauthorized access to any portion or feature of the App or any other systems or networks connected to the App; e. Share your account credentials with others or allow anyone else to access or use your account; f. Use the App to harass, abuse, or harm others or engage in any behavior that is harmful, abusive, or harassing; g. Use the App to collect, store, or process any personal information of other users without their explicit consent; h. Use the App in any manner that violates applicable laws or regulations.

Intellectual Property Rights The XPr Ensue App and all intellectual property rights, including but not limited to trademarks, logos, designs, and software, are and will remain the exclusive property of [Xperience Health Sverige AB] and/or its licensors. This EULA does not grant you any rights to use any trademarks, logos, or other proprietary content of [Xperience Health Sverige AB].

Privacy Your use of the XPr Ensue App is subject to the XPr Ensue Privacy Policy. By using the App, you consent to the collection, storage, and processing of your personal information in accordance with the Privacy Policy.

Disclaimer of Warranties The XPr Ensue App is provided ”as is” and without warranties of any kind, either expressed or implied. [Xperience Health Sverige AB] disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Your use of the App is at your own risk.

Limitation of Liability To the maximum extent permitted by applicable law, [Xperience Health Sverige AB] and Xperience Health Sverige AB shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use or inability to use the XPr Ensue App, even if they have been advised of the possibility of such damages.

Termination This EULA is effective until terminated. [Xperience Health Sverige AB] may terminate this EULA at any time without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete it from your mobile device.

Modifications to the EULA [Xperience Health Sverige AB] reserves the right to modify or update this EULA at any time. Any changes will be effective upon posting the revised EULA within the App. Your continued use of the App after the changes have been made constitutes your acceptance of the modified EULA.

Governing Law and Jurisdiction This EULA shall be governed by and construed in accordance with the laws of Sweden. Any disputes arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts located in Sweden.

Severability If any provision of this EULA is found to be invalid, illegal, or unenforceable, the remaining provisions shall not be affected and shall continue in full force and effect.

Entire Agreement This EULA constitutes the entire agreement between you and [Xperience Health Sverige AB] regarding the XPr Ensue App and supersedes any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
